Online Gambling & Casinos in West Virginia

Perhaps influenced by its large northern neighbor (Pennsylvania), West Virginia has blossomed into a gambling-friendly state. Over the last several years, the transformation has included commercial casinos, sports betting, and online gambling. These join the state lotto, pari-mutuel wagering, video lottery terminals, and charitable gaming.

If we had to nitpick, we’d argue that 5 commercial casinos might seem a little constrained for a population of roughly 1.8 million. Still, with legal online casinos, this is not such a big deal anymore. West Virginians can now safely enjoy slots, table games, and sportsbooks at online casinos.

West Virginia Gambling Overview

West Virginia is among the most liberal states when it comes to different types of gambling. Perhaps part of this is influenced by neighboring Pennsylvania to the North East. Authorized forms include pari-mutuel wagering, charitable gaming, a state lottery, VLTs, commercial casinos, sports betting, and (more recently) online gambling.

Charitable Gaming

Bingo games and raffles in West Virginia may be run by tax-exempt charitable or public service organizations licensed by the Tax Commissioner. These organizations include humane, civic, patriotic, educational, philanthropic, fraternal, and religious. It must have existed for at least 2 years before applying for an annual, occasional, or State Fair license.

Retail sports betting in West Virginia is also available at land-based casinos. Like online sports betting, it covers professional and collegiate events.

Pari-Mutuel Wagering

West Virginia allows pari-mutuel wagering on horse racing and greyhound racing events at four commercial racetracks. The industry is supervised by the West Virginia Racing Commission. In addition to live racing, the state also permits simulcast broadcasting and advance deposit wagering by phone or over the Internet.

State Lottery

The West Virginia Lottery produces annual sales of over $1.1 billion, generating $520 million annually. This money goes towards social programs for seniors, tourism, state parks, and education. West Virginians can purchase over 40 instant games, such as Keno Go, Cash 25, Daily 3, and Daily 4. As a member of the Multi-State Lottery Association, the West Virginia Lottery also sells multistate draw tickets, including Powerball, Mega Millions, and Lotto America.

VLTs

Video lottery terminals were initially approved at the state’s land-based casinos. However, 7 years later, the Limited Video Lottery Act was passed, allowing video lottery machines in adult retail locations like bars.

West Virginia Gambling History

West Virginia has a history of racing and wagering, beginning in 1933 at the Charles Town Turf Club. The West Virginia Racing Commission began regulating the industry 2 years earlier. Wheeling Downs (later renamed Mountaineer Park) was opened in 1951. Between 1997 and 2016, thoroughbred racing contributed close to $1.2 billion.

In 1987, Mountaineer Park introduced video lottery terminals. The Racetrack Video Lottery Act was approved and regulated in 1994, allowing VLTs at racetracks in Virginia.

The West Virginia Bingo Amendment, Amendment 1, was approved on November 4, 1980. It authorized the West Virginia Legislature to amend the State Constitution to allow charitable bingo and raffles.

The West Virginia Lottery was established in 1984 by a voter referendum to amend the State Constitution. In April of the following year, Governor Arch A. Moore, Jr signed the Act into law.

In 1994, the West Virginia Legislature authorized 5 commercial racetrack casinos (racinos). The same year 1,200 VLTs were approved at Mardi Gras, Wheeling, and Mountaineer racetracks through referendums in each county.

In 2001, the West Virginia Legislature expanded VLT locations to include adult retail locations holding licenses from the West Virginia Alcohol Beverage Control Administration. The intent, in part, was to eliminate grey-market poker machines that had cropped up and limit the number of video lottery terminals to 9,000.

In July 2017, Attorney General of West Virginia Patrick Morrisey determined that fantasy sports contests were legal. This is because it is considered more a game of skill than of chance.

In March 2018, West Virginia legalized sports betting. Still, it did not go into effect until PASPA was overturned by the Supreme Court in May. West Virginia later legalized online gambling in February 2019 with the passing of HB 2934. The following year, in July 2020, legalized online casinos were launched.
