West Virginia Gambling History

West Virginia has a history of racing and wagering, beginning in 1933 at the Charles Town Turf Club. The West Virginia Racing Commission began regulating the industry 2 years earlier. Wheeling Downs (later renamed Mountaineer Park) was opened in 1951. Between 1997 and 2016, thoroughbred racing contributed close to $1.2 billion.

In 1987, Mountaineer Park introduced video lottery terminals. The Racetrack Video Lottery Act was approved and regulated in 1994, allowing VLTs at racetracks in Virginia.

The West Virginia Bingo Amendment, Amendment 1, was approved on November 4, 1980. It authorized the West Virginia Legislature to amend the State Constitution to allow charitable bingo and raffles.

The West Virginia Lottery was established in 1984 by a voter referendum to amend the State Constitution. In April of the following year, Governor Arch A. Moore, Jr signed the Act into law.

In 1994, the West Virginia Legislature authorized 5 commercial racetrack casinos (racinos). The same year 1,200 VLTs were approved at Mardi Gras, Wheeling, and Mountaineer racetracks through referendums in each county.

In 2001, the West Virginia Legislature expanded VLT locations to include adult retail locations holding licenses from the West Virginia Alcohol Beverage Control Administration. The intent, in part, was to eliminate grey-market poker machines that had cropped up and limit the number of video lottery terminals to 9,000.

In July 2017, Attorney General of West Virginia Patrick Morrisey determined that fantasy sports contests were legal. This is because it is considered more a game of skill than of chance.

In March 2018, West Virginia legalized sports betting. Still, it did not go into effect until PASPA was overturned by the Supreme Court in May, making West Virginians some of the first Americans to gamble online legally. West Virginia later legalized online gambling in February 2019 with the passing of HB 2934. The following year, in July 2020, legalized online casinos and online casino apps were launched.
