South Dakota Gambling History

Charitable bingo & lotteries were authorized in 1970. A few years later, in November 1986, a constitutional amendment led to the creation of the South Dakota lottery, with the bill signed in April of the following year.

On October 16, 1989, the South Dakota Lottery became the first state to introduce video lottery terminals. In just three years, a Bill to prohibit video lottery terminals was rejected by voters in November 1992. The Supreme Court weighed in June 1994 ruling video lottery as unconstitutional.

They were subsequently shut down by court order until voters approved a constitutional amendment in November of the same year, re-authorizing them. Another attempt to repeal video lottery terminals in South Dakota was rejected by voters in 2000 and again in 2006.

The first tribal gaming compact was signed on August 2, 1990, followed by further agreements in subsequent years.

In November 2015, Attorney General Marty Jackle clarified that fantasy sports contests that don’t involve an exchange of money are permitted under South Dakota law.

On November 3, 2020, South Dakotans approved a constitutional amendment (margin of 3:2) to allow sports betting in Deadwood casinos and tribal casinos. Commercial casinos in the former mining town were authorized to offer slot machines and card games in 1988 after a constitutional amendment.

Deadwood’s history dates back to the gold rush in the late 1800s. Other table games like roulette, craps, and keno were later approved on a November 4, 2014, ballot. South Dakota voters have shown a readiness to back betting, if it can be shown to be beneficial to the municipality. This may benefit moves to implement online gambling in the future.
