Online Gambling & Casinos in North Dakota

The last time North Dakota regulated a new form of gambling was in 2002 with the state lottery. It joined pari-mutuel wagering, charitable gaming, and tribal casinos among authorized forms of gambling in the Peace Garden State. In the first quarter of 2021, attempts to authorize sports betting died in the Chamber. Other initiatives to introduce online gambling, live poker, and online sports betting suffered an identical fate.

North Dakota is not precisely the gambling mecca of the United States. It does have 5 tribal casinos offering slot machines, table games, and sports betting. However, this falls far short of the 24 commercial casinos and 9 tribal casinos in South Dakota. Even though online casinos are not yet legal in North Dakota, some players from the state play there anyway. Whether you’re looking for information on gambling in North Dakota or suggestions on where to play, you can find it all below. North Dakota Gambling Overview

North Dakota, named after the Lakota and Dakota Sioux Native American tribes, was admitted to the Union on November 2, 1889. Its economy is dependent on farming to a greater extent than other states, and petroleum is also an important economic driver.

In terms of gaming, North Dakota’s state lottery, charitable gaming, and the tribal casino compacts fall under the responsibility of the Attorney General. The state prohibits the use of credit cards for gambling and prohibits online gaming. Pari-mutuel betting on horse racing is also permitted, falling under the control of the North Dakota Gaming Commission.

Electronic pull tab gambling is big business in North Dakota. In fiscal 2020, it’s estimated to have raked in $711m. It’s not surprising, given that the state has 3,300+ machines covering about 95% of towns and cities. The popularity of these games has dented tribal casino machine gaming revenue. A Bill attempting to cap the number of pull tab machines and have them less resemble slot machines, backed by tribal leaders, failed to garner the necessary support.

State Lottery

The North Dakota Lottery is responsible for regulating, supervising, and administering the state’s lottery operations. North Dakota has over 400 licensed retailers, such as convenience stores, pharmacies, supermarkets, and gas stations. Prizes of $5,000 or more are subject to a 2.90% state income tax.

Interestingly, the North Dakota Constitution only permits multi-state draws, including Powerball, Lucky For Life, Mega Millions, Lotto America, and 2By2.

Charitable Gaming

The Charitable Gaming Division regulates and has enforcement powers in North Dakota. It is the oldest form of gambling in the state and available in several forms:

Bingo: Conducted by licensed charitable gaming organizations and local permit and charity local permit holders. Players must be 18+ to play bingo and electronic quick shot bingo.

Electronic Pull Tabs: Offered by licensed gaming organizations that have received training from the Gaming Division.

Poker: Conducted by a licensed charitable organization, up to twice per year. Bets are limited to $1, and players must be 21+.

Pull Tabs: The maximum cash prize is $500 for a winning symbol or number. Players must be 21+.

Raffles: There is no minimum age unless set by the organization.

Sports Pool: Conducted at licensed sites with cash prizes only and a max cost per line/square of $25. Players must be 21+.

Twenty-One: Minimum wagers must not exceed $3, and maximum wagers must not exceed $25. Players must be 21+.

Paddlewheel: This is a numbered wheel with a pointer.

Pari-Mutuel Dog & Horse Racing

Pari-mutuel dog & horse racing and gambling fall under the supervision of the North Dakota Racing Commission. Both live and simulcast racing fall under its remit. The state has 2 commercial racetracks: Chippewa Downs and ND Horse Park.

There are 3 brick and mortar sites in North Dakota where players can make live bets. North Dakota also allows off-track betting online, the only legal form of internet gambling offered by 123Gaming Inc., PariBet,, and Lien Games Racing LLC.

North Dakota Gambling History

In 1987, the North Dakota Legislature authorized pari-mutuel horse racing. The same year, it established the North Dakota Racing Commission to regulate the industry. Off-track betting legislation was enacted 2 years later, in 1989. Regulations for OTB and simulcast racing were adopted in 1990.

In 2002, the Constitution of North Dakota was amended, authorizing it to join the multi-state lottery. The lottery began running in 2004.

Fast forward over a decade later (2017) when electronic pull tabs were approved and introduced in August 2018. In 2019, an effort to introduce sports betting statewide failed to gain traction.

In September 2020, IGT (gaming provider) announced a partnership deal with the Turtle Mountain Band of Chippewa Indians to provide sports betting to its two casinos: Sky Dancer Casino & Resort and Grand Treasure Casino. The Dakota Magic Casino and Hotel would later announce a partnership with IGT in June 2021.

The North Dakota House approved the idea of online poker on March 30, 2021. However, the Senate decided unanimously to kill ND3012 and ND1389. These Bills would have put online poker on a 2022 statewide ballot.

On February 2, 2021, ND3032 to authorize sports betting in North Dakota was introduced. It made it to the second reading, where it died in Chamber on March 3, 2021, by a slim margin against 24-23. A Bill (ND2314) that would have authorized online gaming and online sports betting by tribes died in Chamber on February 10, 2021.
